Q: Are there any exceptions to mandatory consecutive sentencing for Dangerous Crimes Against Children (DCAC) charges?
There are very few exceptions to mandatory consecutive sentencing for sexual offenses. If you have been charged with Child Molestation, a Dangerous Crimes Against Children, or Sexual Abuse, a Dangerous Crimes Against Children, the judge may, in his or her discretion, allow for a concurrent sentence. However, this option is not available to the judge if there is more than one victim. Moreover, even in instances where there is only once victim involved, concurrent sentencing is discretionary and therefore rarely applied. If you have been convicted of Child Molestation, a Dangerous Crimes Against Children and there is than one victim, the judge must order you to serve your sentence consecutively, or back to back for each count.
