Q&A: Suspended Sentence

Question:

Will my son have to go to jail or is there a possibility of a suspended sentence?  My son has a prior felony from about 4 years ago and was just found guilty of trafficking stolen property. Is there a possibility of a suspended sentence? I have heard different views on this. Some have said he has to go to prison and some say he could get a suspended sentence or Intensive Probation, could someone let me know if there is any hope.

Answer:

In the state of Arizona, if you have a prior felony conviction and are convicted of a new felony offense, you must be sentenced to the Department of Corrections. However, an experienced criminal defense attorney may be able to negotiation a plea bargain which calls for something less than prison, such as probation and/or jail. I would advise anyone facing criminal charges to consult with an experienced attorney before making any decisions regarding plea negotiations. There are many excellent attorneys on this forum.
