Q&A: Filing Charges

Question:

I was stopped and allowed the cops to search my car. they found pills. i went to jail and never knew until i went bfor the judge that i was arrested for drug paraphenalia. they never mentioned this during the stop or after. should i haver been told? i was not aware of anythihgn being in my car

Answer:

Ultimately, it is the prosecuting agency in your jurisdiction, not the police, who will determine what charges to file against you. As long as probable cause exists to support the charge, the state can add charges subsequent to your arrest. It’s best to consult an experienced criminal defense attorney to review your case for legal and constitutional violations and ensure the best possible results. Feel free to call with additional questions. Good luck!
