Q&A: Phoenix Criminal Law – Discovery/Restitution

Question:

I go back to court in January for case management, at what point do I ask for disclosure from the prosecutor and what info am I allowed to ask for? I am also trying to get info from other persons insurance company on what exactly they covered on damages and for how much can hos insurance company give me a hard time about sending me info? Can the prosecutor go after me for criminal damages $250 if this is the deductable?

If this is a case management hearing, your attorney should have already requested discovery. I would advise you to consult your attorney about the specific discovery requests made in your case since each case is different and the evidence may vary. Also, if convicted by plea or guilty verdict, you are liable for any restitution claim made by the victim(s) as long as the claim is reasonably related to the offense. This may include any deductibles paid by the victim as well as reimbursement to the insurance company for any money they’ve lost making the victim whole.
