I was charged with failure to register and put on lifetime probation. Is it legal?  I had two residences. one I owned which I considered my main residence, and one getaway place for a stress reliever. I rented that place with another family. I registered my main address, but not the second one. I was charged with failure to register and put on lifetime probation in Arizona. Do I have a case?

Without knowing the specific facts in your case , it’s difficult to offer a fair legal assessment. However, the most likely scenario is, yes, the state has a case against you. In order to charge you with Failure to Register, the state must not only establish that you violated the statute, but that you have an underlying conviction which requires registration. Believe it or not, this can be a very difficult hurdle for the state to overcome in many instances.

As a registered sex offender, you are required to update your address if you are staying at any one residence for more than 72 hours. Since Failures to Register of this nature constitute a class 4 felon in the state of Arizona, and since you have at least one underlying conviction (i.e. the sex offense), you may be facing very serious prison time.
