How much time can someone get for burglary if there record is clean?
my boyfriend got charge with burglary when he was in a junk yard walking around looking for part for his car he didnt steal anything. he is 19

The sentencing range on a class 4 felony, first offense, is 1-3.75 years in the department of corrections. 1 year is the mitigated term , which requires that the court find mitigating factors on the records before the court can sentence you to 1 year. 3.75 years is the aggravated term, which requires that the court find aggravating factors on the record before the court can sentence you to 3.75 years. 2.5 years is the presumtive term, which is where the court will start. It’s important to keep in mind that for most first time offenses, you are probation eligible. However, even if given probation, you can face up to 1 year in the county jail.
