Q&A: Phoenix Criminal Defense – Extradition

Question:

no formal charges have been brought against me yet but i have been questioned and the case is being sent to the county prosecutor so they can formally charge me. i took some scrap metal from the river and sold it apparently it belonged to the the city so basically what would they do if i were to leave the state before they formally charge me

Additional information:
i dont know what the charge would be but i was told probably a class 1 misdemeanor because its my first offense, also what charges would i get if i were to leave the state? if a warrant is issued for me will it be visible all over the country

Answer:

In the state of Arizona, theft of property valued at less than $1000 is a misdemeanor offense. If the prosecutor reviews the police report and decides to charge you with theft, they can then issue a warrant for your arrest. It is within the discretion of the prosecuting agency to issue an Arizona only warrant, or a nation wide warrant. Given the nature of the described offense, it is unlikely that the prosecuting agency will issue a nation wide warrant in your case; however, there are never any guarantees. If a nation warrant is issued and you are arrested in your current state, you may be extradicted back to this state to deal with the charges against you. The decision to extradict is made on a case-by-case basis and also depends upon the charges filed. Hope this helps. Best of luck to you.
