Q&A: Phoenix Criminal Defense – Increased Charges
Question:
Can an aggravated assault charge be changed from one class to another i’m being charged with a class 6 but the prosecution is telling me they are going to change it to a class 4 how is that possible
Answer:
The prosecution has the discretion to recharge you with more serious charges as long as probable cause exists to establish the offense. A class four aggravated assault is a very serious offense. I would advise you to hire an axperienced criminal defense attorney who can help. Best of luck to you!
