Q: Out of State Warrant

Q: I have a warrant in Arkansas(bench I believe). I live in Arizona, will I go to jail If Pulled over?  This is all due to a DWI. The Warrant I believe is a bench warrant (2). One for not completing a day of Jail & the second for failure to pay fine. If I get pulled over in Arizona, will I go to Jail? Also, will they send me to Arkansas?

A: You will likely be detained; however, it’s it’s an Arkansas only warrant, the state of Arkansas may choose not to extradite. Keep in mind, you may wait in custody for a significant period of time before Arkansas makes a decision. I recommend that you contact a criminal defense attorney in Arkansas to assist you.
