Q&A: Expunging Records
Question:
I was arrested of criminal damage, and then dismissed when I meet with prosecutor. How can I expunge my criminal record? I am in Arizona, I was arrested because I broke my bedroom door by mistake two weeks ago(I rent an apartment), and the police say it is criminal damage. Then when I met the prosector, I was dismissed. However, they told me there is still criminal record, and it shows dismissed. May I know how can I expunge my criminal record? Is there any possibility I can expunge the record myself, or I need to find a lawyer?
Thanks.
Answer:
You cannot expunge your record in the state of Arizona. However, if you had a criminal conviction, you could request a “set aside”. Since your case was dismissed, there is nothing for the judge to set aside. A dismissal of the charges should be reflected on your criminal record.
