Q&A: How Do I Get Charges Expunged?

Question:

How do i clear 10 year old charges in two countys after completing drug diversion.  i was arrested in 1996 in california for controlled substance in santa clara county failed to complete drug diversion and was arrested in los angeles in 2001 after a traffic stop, there were no drugs but i was charged because of not completing my drug diversion, was transported to san jose and charged for same crime i completed my drug diversion and was given a letter stating that i did not have to say i was arrested for that crime but the 2 charges have not been cleared this came up in a fbi check for a job and i have to clear these open charges before i can work, i wrote the courts but have heard nothing back yet
should i get an attorney and how long will it take and the cost i do not need them sealed or expunged just a disposition.

Answer:
In the state of Arizona, you cannot have a charge expunged from your record. However, certain crimes may qualify for a set aside. If your convictions are from California, you would need to talk to an attorney who specializes in criminal law from California as the law may vary from state to state. Good luck!
